在高度競爭環境下,產業從技術競爭、價格競爭的商業競逐,近年進而轉為以智財權的訴訟發動來達成阻擊競爭對手技術的羈絆與干擾;而在專利侵權訴訟,被控侵權一方得以反制手段對系爭專利提出舉發挑戰其專利有效性,扭轉訴訟過程劣勢,更進一步得尋求將訴訟情勢導向和解談判。本論文運用個案研究方式,以中華民國專利公告號I317967的相關訴訟所引發的專利舉發案為例。該專利自2011年至2019年陸續遭人提出6件舉發案,第1到第4次舉發案中所提出證據及其說明皆未能成立,第5件舉發案則由舉發人自行撤回,最終智慧財產局於2020年4月第6次專利舉發案做出舉發成立審定;而訴訟雙方在2020年末之際,宣布就該民事訴訟案達成

和解,該專利的無效應為雙方停止此多年爭訟的關鍵轉折所在。專利舉發成立與否的關鍵在於證據。而此個案在長達十年的專利舉發過程中共涉及專利前案33件、審查意見書7件、行政訴訟書狀及判決5件、技術手冊1件、宣誓書1件、教科書1件、產品實品1件以及答辯補充理由書1件,種類繁雜而且採納或不採的理由不一,因此本論文就該專利舉發案所提證據及智慧財產局判斷理由做彙整與解析,以期本論文的結論得以於未來專利有效性的爭執中提供業界作為參考。

台灣IC設計產業逐漸在國際半導體製造商中嶄露頭角,但由於缺乏自主研發所需的關鍵核心技術。因此,戰略聯盟和競爭合作成為企業快速獲得專利和佈局市場的手段。然而,台灣供應鏈上下游的上市公司近年來一直面臨國際上的專利侵權訴訟。因此,本研究主要希望為投資者在企業面臨專利訴訟時提供應對的投資策略。透過事件研究法對標的股票的異常報酬進行分析,並根據結果使用橫斷面迴歸模型及分量迴歸探索美中貿易戰與COVID-19期間及不同因素與不同分量下的變化。實證結果顯示,公司面臨專利訴訟會產生正向顯著的異常報酬,且事件日後累計異常報酬均為正向且顯著,說明公司在面臨專利訴訟時仍有盈利機會,可供投資者參考。根據橫斷面迴歸分

析,其交易量為負向且顯著,表明投資人視其為關鍵變數。在分量迴歸分析中,隨著分位數的變化,原先在0.05、0.25、0.5、0.75無顯著變數,在0.95時,除了成交量外,其他變數皆為呈現顯著。因此,這些變數對累積報酬的宣告效應是有所不同的。
