竊盜犯罪的發生率與再犯率均高，對民生經濟影響甚鉅，是地方公共安全的重要指標，在司法精神鑑定當中，亦是相當常見的犯罪類型。本研究希望藉由精神病人犯竊盜案之司法精神鑑定結果與法院判決報告，了解責任能力、竊盜再犯以及監護處分之相關問題。 本研究以2002年到2004年於衛生福利部草屯療養院進行精神鑑定的143名竊盜犯個案為研究對象，根據其責任能力、再犯狀況、監護處分狀況進行分組，分析犯竊盜案件之精神病人的流行病學統計結果、影響責任能力判決的因素、鑑定與判決結果之一致性、竊盜再犯的影響因素、影響監護處分判決的因子，以及監護處分之效果。 研究結果發現，個案的精神診斷與前科對責任能力

以及竊盜再犯有關聯性，其他人口學因子包括年齡、婚姻狀況與責任能力有相關性。建議繼續深入研究個別精神疾病的犯罪樣態，及其病理特徵與責任能力之關聯性，並將研究結果應用於精神鑑定以及監護處分的政策制訂。
