AEPD的判決而廣為人知,並於GDPR 中正式法制化。2018年施行的GDPR係引領全球重要的個資保護規範,不僅透過「適足性認定」影響著日、韓、新加坡等各國的個資法規修訂,我國的個資法也將以該法規作為範本進行修法。然而被遺忘權的發展幾乎跨不出歐盟的疆域,若我國欲引進被遺忘權法制,勢必將參照各國的個資法規現況,了解被遺忘權在歐盟以外難以落實之主因。尤其先進國家相繼成立個資保護委員會/隱私保護局,行政機關在被遺忘權審查上之角色為何亦值得探究。是以,本文就個資保護源自於隱私權之背景為完整的說明與介紹,探詢被遺忘權在基本權利上的定位。
