臺灣是以機車密度與機車的製造技術聞名的機車王國,但是直到2002年加入WTO之後,才重新開始進口排氣量150cc以上的機車。但於初開放之際,排氣量及性能高出普通重機數倍的大型重型機車,行駛路權仍然比照一般機車,在歷經多次抗爭與改革後,分別於在2007年、2012年陸續放寬行駛國道高速公路的權利。但法令經三讀通過、公布實施至今已十年,卻未見任何一條國道有實際開放大型重型機車行駛。在探究大型重型機車騎士的駕駛經驗及駕駛態度現況,是否適合行駛國道。研究對象為以臺灣北部地區的大型重型機車駕駛人為主,採取線上問卷以及面訪問卷的調查方式,總計發出 154份問卷,有效樣本為149 份。問卷調查所得資料以描

述性統計、單因子變異數分析及Pearson積差相關係數分析等統計方法進行數據資料分析與處理。研究發現為大型重型機車駕駛人會因「年齡」、「教育程度」及「騎乘大型重型機車被取締交通違規的頻率」不同而在「駕駛態度」有差異存在。會因「年齡」、「騎乘大型重型機車的平均公里數」、「大型重型機車品牌」以及「最主要使用的交通工具」不同而在「駕駛經驗」有差異存在。研究建議為針對剛接觸大型重型機車不久的年輕族群,應再增加道路駕駛經驗與國道安全的課程,規定必須完成指定的課程及測驗才能取得行駛國道的資格。用以降低駕駛侵略性,減少發生交通事故的可能。

人民日常生活上價格最高昂之買賣標的物且與生活起居息息相關者,為房屋,次之,為汽車。當一生汲汲營營賺取金錢,投入幾乎全數資金購買理想上之房屋,如有漏水瑕疵,可依物之瑕疵擔保責任請求相關之法律效果獲得救濟,並無疑問。惟房屋如有發生非自然身故之情事導致房屋價格減損,此時得否依物之瑕疵擔保責任為主張,則有疑問。蓋具有非自然身故情事之房屋通常稱為凶宅,凶宅是否該當物之瑕疵,無論在學說或實務均有肯定及否定之不同見解,此將導致人民於買到凶宅時是否得主張物之瑕疵擔保即無所適從,且凶宅之案件只會不斷增高,因此本文認為須於物之瑕疵擔保責任中,以明文規定凶宅該當價值瑕疵之方式來結束爭議。 當人民需要汽車來滿

足移動之需求而購買新車時,交車後卻發生重大瑕疵影響安全,如主張物之瑕疵擔保責任,將有車商質疑是消費者操作不當,而消費者又因無車輛鑑定之能力自無法舉證車輛於車商移轉予消費者時即具有瑕疵,2021年雖有施行臺灣版之檸檬車條款,惟有擔保期限過短之缺點,於屢修不復之規範中甚至有規避「維修累計三十日可主張解約或換車」之規避條款,使消費者欲主張檸檬車條款為解約或換車之權利,可謂難上加難。因此,本文參考美國及中國之規範,並將之本土化,計算出適合臺灣之擔保期限,並建議刪除規避條款,使臺灣人民購入新車後可獲得最基本之法律保障。 如僅著墨於國內物之瑕疵擔保責任規範之探討將有故步自封之嫌,因此,參考外國法之規範,

得以拓展視野發現他國優點改進我國不足之處。首先中國民法典於 2021 年施行,此乃較新穎之民法典,同時地理位置及文化相近,適合作為參考。另外則係參考國際潮流趨勢,譬如聯合國國際商品買賣契約公約乃多國相繼參考並作為國內法修訂之依據,因此其優勢之處自有研究之必要,綜合上述研究,俾使我國物之瑕疵擔保責任之規範更為全面。
